By submitting the booking form, you (the "Participant") acknowledge and agree to the following terms regarding your participation in the Historic Filipinotown Jeepney Tour (the "Event") organized by Pilipino Workers Center (the "Organization").
You understand that participating in a Jeepney tour involves inherent risks. These include, but are not limited to:
Transportation Risks: Boarding and exiting a high-step vehicle, jolts from uneven road surfaces, traffic accidents, and exposure to weather conditions (heat, rain, wind).
Environmental Risks: Exposure to air pollution, dust, noise, and navigation of public spaces or crowded pedestrian areas.
Physical Activity: Walking on uneven terrain during stops or standing for periods of time.
You voluntarily assume all known and unknown risks associated with the Event.
The Event may include stops for food and drink or provide refreshments.
Allergies: You acknowledge that it is your responsibility to inform the Organization of any life-threatening allergies. However, the Organization cannot guarantee an allergen-free environment.
Food-Borne Illness: You assume all risks related to the consumption of food and beverages during the tour, including "street food," and release the Organization from liability for any illness, allergic reactions, or digestive issues that may arise.
The Organization is not responsible for the loss, theft, or damage of personal belongings (cameras, phones, wallets, etc.) during the tour. You are encouraged to keep your valuables secure and be mindful of your surroundings in public areas.
You certify that you are in good health and have no physical conditions that would make participation dangerous to yourself or others. You agree to follow all safety instructions provided by the driver or tour guide. The Organization reserves the right to remove any Participant who acts in a manner that endangers themselves or others, without a refund.
To the fullest extent permitted by law, you hereby release, waive, and forever discharge the Organization, its owners, employees, and contractors from any and all liability, claims, or causes of action arising out of:
Personal injury or death.
Property damage or loss.
Medical expenses incurred as a result of participation.
You further agree to indemnify and hold harmless the Organization against any claims brought by third parties resulting from your own actions or negligence during the Event.
In the event of an injury or medical emergency, you authorize the Organization to seek or administer first aid and/or medical transport at your expense. This waiver applies to any injuries sustained during such medical interventions.
This agreement shall be governed by and construed in accordance with the laws of the state of California. If any portion of this waiver is found to be invalid, the remaining portions shall remain in full force and effect.
